These Trade Terms apply to vehicles offered by PITLANE MOTORS LTD to motor traders, dealers and other business buyers. Our vehicles are supplied strictly on a business-to-business trade sale basis.

1. Trade-only supply

Pitlane Motors supplies vehicles to motor traders, dealers and business buyers only. We do not supply vehicles from this website as retail consumer sales.

By enquiring about, reserving or purchasing a vehicle from us, the buyer confirms that they are acting in the course of business and not as a private consumer.

2. Trade sale basis

Vehicles are offered and supplied on normal motor trade terms. Unless expressly agreed by us in writing for a specific vehicle and transaction, no warranty, guarantee, aftersales cover or retail consumer protection package is included.

The buyer is expected to have the skill, experience and trade knowledge necessary to assess a used vehicle, its condition, documentation, provenance, value and suitability for resale or business use.

3. Used vehicle condition

All vehicles are used vehicles. Used vehicles may have age-related wear, prior repairs, previous paintwork, cosmetic defects, mechanical wear, service history gaps, import history, or other matters consistent with their age, mileage, use and market history.

Any description such as “prepared”, “forecourt-ready”, “retail-ready”, “ready to sell” or similar is a commercial description of the preparation process carried out before sale. It does not create a warranty, guarantee, promise of future performance, or assumption of post-sale liability.

4. Vehicle information and files

We may provide vehicle files, photographs, videos, inspection notes, preparation records, invoices, MOT/compliance records, import records and other supporting information. These are provided to assist trade buyers in assessing the vehicle before purchase.

Vehicle files and supporting documents are not a warranty. They are a record of information available to us and work carried out or arranged before sale. Buyers must review the available information and ask any questions before committing to purchase.

5. Inspection before purchase

Buyers are strongly encouraged to inspect vehicles, review the vehicle file and satisfy themselves as to condition, specification, documentation, mileage, import status, value and suitability before purchase.

If a buyer chooses to purchase without inspecting the vehicle in person, they do so as a trade buyer relying on their own judgement and the information they have chosen to review before purchase.

6. Prices, suggested retail and margins

Wholesale prices, stock availability and vehicle status may change without notice until a transaction is confirmed.

Any suggested retail price, indicative margin, comparable value or market commentary is provided for general trade guidance only. It is not a guarantee of resale price, profit, time to sale, market demand or future value.

7. Import status

Vehicles may be imported vehicles. Import status is disclosed where applicable and buyers are responsible for considering how this affects their own resale description, advertising, insurance discussion, customer disclosure and onward sale obligations.

8. No reliance outside confirmed written terms

The buyer agrees that they do not rely on any statement, estimate, discussion, message, website wording, suggested retail price, margin indication or informal comment unless it is expressly confirmed by us in writing as a term of the specific transaction.

Nothing in these terms limits or excludes liability for fraud or fraudulent misrepresentation.

9. Payment, release, collection and delivery

Payment terms will be confirmed for each transaction. Unless we agree otherwise in writing, vehicles will not be released until cleared funds have been received.

Collection, transport and delivery arrangements are the buyer’s responsibility unless expressly agreed otherwise. Risk in the vehicle passes to the buyer on collection, delivery handover or release to the buyer’s appointed transport provider, whichever occurs first.

10. Exclusion of warranties and implied terms

To the fullest extent permitted by law, and subject to the reasonableness requirements applying to business-to-business contracts, all warranties, conditions or terms that may otherwise be implied by statute, common law, trade custom or course of dealing are excluded.

Nothing in these Trade Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability relating to title where such exclusion would be unlawful, fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

11. Limitation of liability

Subject to anything that cannot lawfully be excluded or limited, Pitlane Motors shall not be liable for loss of profit, loss of resale opportunity, loss of business, loss of goodwill, consequential loss, indirect loss, preparation costs, advertising costs, storage costs, transport costs, finance costs or other losses arising after the trade purchase.

Subject to anything that cannot lawfully be excluded or limited, our total liability in connection with any vehicle transaction shall not exceed the price paid to us for that vehicle.

12. Buyer’s onward sale responsibilities

The buyer is responsible for their own onward resale process, advertising, pricing, customer disclosures, warranty decisions, consumer compliance and any preparation or checks they choose to carry out before retail sale.

13. Errors and omissions

We take care when presenting stock, but errors, omissions or changes may occur. Buyers must confirm any detail that is material to their purchase decision before committing to buy.

14. Governing law

These Trade Terms and any vehicle transaction with PITLANE MOTORS LTD are governed by the laws of England and Wales. The courts of England and Wales shall have jurisdiction unless otherwise agreed in writing.
